REGULATIONS OF THE WORKSHOPS

Sound Collective Foundation is proud to invite you to the VIII CORNO Brass Music Festival, which will take place between 19 and 24.08.2024 in Zielona Góra. This is the eight edition of the largest brass music festival in Poland, during which there will be instrumental workshops, various concerts, yoga for musicians, breathing therapy, lectures and an exhibition of instruments. We invite eminent artist in the following specialties: French horn, trumpet, trombone, tuba and euphonium.

  1. The organizer of the festival is Sound Collective Foundation, based in Wrocław, Saperów 19/7, 53-151, having a REGON number: 365737380, NIP 8943087898.
  2. The condition of participation in the CORNO Brass Music Festival for a given specialty is to complete the application form on the website www.corno.pl and to pay the registration fee by 30.06.2024 at the latest. A copy of the proof of payment should be sent to the email address workshop@corno.pl.
  3. In the case of resignation from participation in the festival, the registration fee is not refundable.
  4. Signing up for a workshop of any specialty means accepting the rules and privacy policy, visible at corno.pl.

Warning! Transfer fees and any other bank fees are borne by the course participant. The amount paid into the account as a participation fee should be exactly the same amount as given in the regulations.

  1. The number of active participants is limited. The order of applications with confirmation of payment for participation in the workshop will determine the qualification to the group of active participants.
  2. The organizer does not provide care for underage participants. Persons under the age of sixteen must come with a legal guardian. We accept entries for a maximum of six people under the age of sixteen per instrument.
  3. Travel costs, accommodation and meals are covered by participants and carers on their own. It is possible to book the accommodation presented in the application form for active workshop participants (the order of applications counts, the number of places is limited).
  4. Each of the active participants in each specialty will take part in individual lessons, lessons with accompaniment, breathing therapy and chamber ensembles classes; may listen to all other lessons during the festival and may also take part in concerts of the participants. She/He will also receive a free admission to all festival concerts. The repertoire carried out during the classes will be determined by the organizer.
  5. Each of the passive participant can listen to all the lessons during the festival and will also be able to buy tickets for festival concert at a discounted price.
  6. Artists and festival participants agree to publish their image in archival, promotional and informational materials that will be created during the event and will be used in the future for the festival’s archival and promotional purposes.
  7. The organizer reserves the right to cancel each of the specialties in the case of too few applications of active participants, which will be notified to both the lecturer and the submitted participants not later than within 21 days before the beginning of the course.
  8. The organizer reserves the right to change the tutor of each specialty in the case of illness or other random events, about which the participants will be informed as soon as possible.
  9. Participants of the festival bear legal and financial responsibility for damage caused in places of individual classes, group classes, concert halls and accommodation during the festival.
  10. The organizer is not responsible for the safety of festival and music workshop participants on their way to the festival, during the festival and on their way back from the festival.
  11. The Organizer reserves the right to make changes to the schedule and program of the festival.

SHOP REGULATIONS

Firstly, our full registration details: Kolektyw Dźwięku Foundation, with its registered office in Wrocław, ul. Saperów 19/7, 53-151, registered under REGON number: 365737380, VAT identification number: 8943087898.

Below you will find the regulations which include information on how to place an order leading to the conclusion of a contract, details concerning the performance of the concluded contract, delivery and payment methods available in the shop, the procedure for withdrawal from the contract, and the complaint handling procedure.

Definitions

For the purposes of this regulation, the following definitions apply:

Buyer – a natural person, legal person or a legal entity,
Consumer – a natural person who enters into a sales agreement with the Seller that is not directly related to their economic or professional activity; a Consumer is also a Buyer,
POCK – a natural person who enters into an agreement with the Seller directly related to their economic activity, where the content of this agreement indicates that it does not have a professional character for this person, arising in particular from the subject matter of their economic activity, made available under the provisions of the Central Register and Information on Economic Activity; POCK is also a Buyer,
Shop – an online shop operating at corno.pl,
Seller – Kolektyw Dźwięku Foundation.

Preliminary provisions

Through the Shop, the Seller conducts retail sales, providing electronic services to Buyers. Through the Shop, the Buyer can purchase products displayed on the Shop’s pages.
The regulations specify the rules and conditions for using the Shop, as well as the rights and obligations of the Seller and Buyers. To use the Shop, in particular to make a purchase in the Shop, it is not necessary for the Buyer’s computer or other device to meet specific technical requirements. The following are sufficient: access to the Internet, standard operating system, standard web browser, an active email address.

The Buyer cannot make a purchase in the Shop anonymously or under a pseudonym.

It is prohibited to provide unlawful content while using the Shop, in particular by sending such content through forms available in the Shop.

All prices of products provided on the Shop’s pages are gross prices.

Electronic services

Through the Store, the Seller provides electronic services to the Buyer.

The basic electronic service provided by the Seller to the Buyer is the possibility of placing an order in the Store leading to the conclusion of a contract with the Seller. Placing an order is possible without the need to have an account in the Store.

The services provided electronically are provided to the Buyer free of charge. However, sales contracts concluded through the Store are subject to a fee.

In order to ensure the Buyer’s security and the transmission of data in connection with the use of the Store, the Seller takes technical and organizational measures appropriate to the degree of risk to the security of the services provided, in particular measures to prevent the acquisition and modification of personal data by unauthorized persons.

The Seller takes actions to ensure the proper functioning of the Store. The Buyer should inform the Seller of any irregularities or interruptions in the functioning of the Store.

Any complaints related to the functioning of the Store may be submitted by the Buyer via e-mail to office@corno.pl or workshop@corno.pl. In the complaint, the Buyer should specify the type and date of occurrence of the irregularity related to the functioning of the Store. The Seller will consider all complaints within 30 days of receiving the complaint and will inform the Customer of its decision by e-mail to the address provided in the complaint.

Order placement

The buyer can place an order without registration.

Placing an order is done by filling out the order form after adding the products of interest to the buyer’s cart. The form requires the necessary information for order fulfillment. At the order placement stage, the buyer also chooses the method of delivery of the ordered products and the payment method for the order. Placing an order requires acceptance of the terms and conditions, which the buyer should read beforehand. If the buyer has any doubts regarding the terms and conditions, they can contact the seller.

The order placement process is completed by clicking the button finalizing the order. Clicking the button finalizing the order constitutes the buyer’s declaration of will leading to the conclusion of a sales contract with the seller. If the buyer chose online payment when placing the order, clicking the button finalizing the order will redirect them to the PayPal payment gateway.

If the buyer chose bank transfer payment, clicking the button finalizing the order will redirect them to the Store’s page with an order confirmation and payment instructions. Payment for the order should be made within 48 hours from the conclusion of the contract.

The buyer must provide accurate personal data in the order form.The buyer is responsible for providing false personal data. The seller reserves the right to suspend the order fulfillment if the buyer provided false data or if these data raise reasonable doubts as to their correctness. In such a case, the buyer will be informed by phone or email about the seller’s doubts. In such a situation, the buyer has the right to explain all circumstances related to verifying the truthfulness of the provided data. If there are no data allowing the seller to contact the buyer, the seller will provide all explanations after the buyer initiates contact.

The buyer declares that all data provided by them in the order form is accurate, while the seller is not obliged to verify their truthfulness and correctness, although they have such a right under the above point 7.

Delivery and payment

The available methods of order delivery are described on the Store’s page and are presented to the buyer at the order placement stage.

If the buyer requested an invoice, it will be delivered to them electronically, to the email address provided in the order form.

Order fulfillment

Order fulfillment involves providing purchased services within the time frame specified during the ordering process.

Withdrawal from the agreement by the consumer or POCK The consumer or POCK who has entered into a distance agreement with the seller has the right to withdraw from the agreement without giving a reason within 14 days from the day on which they acquire possession of the purchased goods.

The right to withdraw from the agreement does not apply in cases described in Article 38 of the Consumer Rights Act.

To withdraw from the agreement, the consumer or POCK must inform the seller of their decision to withdraw from the agreement by means of an unambiguous statement – for example, a letter sent by email.

The consumer or POCK may use the withdrawal form provided.

To meet the deadline for withdrawal from the agreement, it is sufficient for the consumer or POCK to send information concerning their exercise of the right to withdraw from the agreement before the deadline for withdrawal from the agreement expires.

The consumer or POCK is obliged to return the product to the seller or to hand it over to a person authorized by the seller to receive it without delay, but no later than 14 days from the day on which they withdrew from the agreement, unless the seller has offered to collect the item themselves. To meet the deadline, it is enough to send the product back before it expires.

Returns are only possible in the original packaging.

The consumer or POCK bears the direct cost of returning the item. In the event of withdrawal from the agreement, the seller shall reimburse the consumer or POCK for all payments received from the consumer or POCK, including the cheapest available cost of delivering the products (if the cost was covered by the consumer or POCK), immediately, and in any event not later than 14 days from the day on which the seller was informed of the exercise of the right to withdraw from the agreement. The refund will be made using the same means of payment as those used by the consumer or POCK in the initial transaction, unless the consumer or POCK has expressly agreed to a different solution. In any case, the consumer or POCK will not incur any fees in connection with the refund. If the seller has not offered to collect the item themselves from the consumer or POCK, they may withhold the reimbursement of payments received from the consumer or POCK until the item is returned or until proof of its return is provided by the consumer or POCK, depending on which event occurs earlier.

The consumer or POCK is responsible for any diminished value of the product resulting from the use of the product beyond what is necessary to establish the nature, characteristics and functioning of the product.

Responsibility for defects

The Seller is obliged to deliver the product free from defects to the Buyer, subject to section 3 below.

The Seller is liable to the Buyer if the sold product has a physical or legal defect (warranty for defects), subject to section 3 below.

The warranty for defects is excluded for Buyers other than Consumers or POCK.

If the sold product has a defect, the Buyer may:

– demand replacement of the product free from defects,

– demand removal of the defect,

– make a statement on a price reduction,

– make a statement on withdrawal from the contract.

If the Buyer finds a defect in the product, they should inform the Seller, specifying at the same time their claim related to the identified defect or submitting a statement of the relevant content.

The Buyer may use a complaint form available HERE, but it is not mandatory.

The Buyer may contact the Seller by traditional mail or e-mail.

The Seller will respond to the complaint submitted by the Buyer within 14 days from the date of receipt of the complaint using the means of communication through which the complaint was submitted.

The details regarding the Seller’s warranty for defects are governed by the provisions of the Civil Code (art. 556-576).

Personal data and cookies

The Seller is the administrator of the Buyer’s personal data.

The store uses cookie technology.

Out-of-court complaint handling and claims enforcement methods

The Seller agrees to submit any disputes arising in connection with the sale of goods to mediation proceedings. Details will be determined by the parties to the conflict.

The Consumer has the option of using out-of-court methods for handling complaints and enforcing claims. Among others, the Consumer has the option to:

– apply to a permanent consumer arbitration court with a request to settle a dispute arising from a sales contract,

– apply to the voivodeship inspector of the Trade Inspection with a request to initiate mediation proceedings for an amicable settlement of a dispute between the Buyer and the Seller,

– use the assistance of the district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection.

Final provisions

The Seller reserves the right to introduce and withdraw offers, promotions, and to change product prices in the Store without prejudice to the rights acquired by the Buyer, including in particular the terms of contracts concluded before the change.

The Seller reserves the right to make changes to the Regulations without prejudice to the rights acquired by the Buyer on the basis of contracts concluded before the change of the Regulations. Buyers who have a registered user account will be informed about any changes to the Regulations by sending a message to the e-mail address assigned to the user account. If the new Regulations are not accepted, the Buyer may delete their user account free of charge.

Any disputes related to contracts concluded through the Store will be considered by a Polish common court having jurisdiction.

This regulation is effective from February 2nd, 2022.
